License Agreement

"OE Classic" authors - in the following text THE AUTHORS, hereby grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the software "OE Classic" (which includes entire content of the original "OE Classic" distribution archive - program binaries, documentation, READMEs and all other files in the distribution archive) - in the following text THE SOFTWARE, subject strictly to the terms of this License Agreement.

For evaluation version the license is granted to use THE SOFTWARE solely for evaluation purposes.

For registered version you have to pay license fee in order to use THE SOFTWARE, by following instructions prompted by the program.

EVALUATION VERSION

For evaluation version permission is granted to use THE SOFTWARE and to redistribute it freely provided that THE SOFTWARE remains unmodified which includes complete original distribution package contents and the package itself (original unmodified archive, software binaries, any included documentation, READMEs, help files and any other files contained in original package), all proprietary notices are left intact and origin of THE SOFTWARE and/or THE AUTHORS are not misrepresented, no fee is charged and no direct or indirect commercial benefit is derived.

RESTRICTIONS (EVALUATION AND REGISTERED)

For evaluation and registered version you are not allowed to modify original package format and any of its contents, which includes but is not limited to modifications, reverse engineering, decompilation or disassembling, except where such restriction is prohibited by applicable law. You are not allowed to create derivative works based on THE SOFTWARE, rent, lease, or otherwise transfer rights to THE SOFTWARE and remove any proprietary notices or labels on THE SOFTWARE or misrepresent THE SOFTWARE origin as well as THE AUTHORS.

REGISTERED VERSION

For registered version, permission is granted to use THE SOFTWARE on any single computer within the activation limits as long as you remain the only user of each copy, to copy THE SOFTWARE for backup purposes provided that each copy contains all of THE SOFTWARE original contents which includes but is not limited to original, unmodified distribution package and its contents with all proprietary notices included.

For the purpose of registration a personalized license key is provided to the licensee. The license key can be used to activate THE SOFTWARE on up to 3 installations. An installation is defined as a single physical computer with a single Windows user account. If multiple Windows user accounts, virtual machines, or any other multi-user environments are configured on the same physical computer, each such environment is considered a separate installation.

The license key grants a time-limited license for a fixed license period. The maximum license period is up to three (3) years from the date of the license key purchase; however, the actual license period may be shorter (for example, one (1) year), as specified at the time of purchase.

The license key can be used to activate THE SOFTWARE only for the duration of the applicable license period starting from the date of the license key purchase. After expiration of the license period, the license key automatically becomes invalid and non-operational, and THE SOFTWARE automatically reverts to the evaluation version with all limitations applicable to the evaluation version.

After expiration of the license period an optional purchase of extension or renewal of the license key for a following license period may be offered at the sole discretion of THE AUTHORS, and THE AUTHORS are under no obligation to offer renewal, extension, or continued availability of the registered version, regardless of prior purchase history, provided THE AUTHORS are still actively developing THE SOFTWARE or holding the rights to it. Expiration of the license period does not constitute a breach of this License Agreement and does not require destruction of the evaluation version.

Single license purchase grants single individual the permission to use the registered version of THE SOFTWARE. For multi-user usage, the same number of licenses must be purchased as the number of individuals using the registered version of THE SOFTWARE regardless of the number of THE SOFTWARE installations, even if a single installation is shared by two or more users. Volume sales are not covered by this license agreement.

For registered version you are not allowed to permit other individuals to use THE SOFTWARE, modify it in any way, which includes but is not limited to modifying original archive format and any of its contents using techniques like reverse engineering, decompilation or disassembling. You are not allowed to create derivative works based on THE SOFTWARE, copy THE SOFTWARE (except as specified above), sell, rent, lease or in any other way transfer rights to THE SOFTWARE to anyone. You are not allowed to remove any proprietary notices or labels on THE SOFTWARE or misrepresent THE SOFTWARE origin as well as THE AUTHORS.

COMMERCIAL USE

For evaluation and registered version of THE SOFTWARE you are not allowed to sell THE SOFTWARE or make any profit of it directly or indirectly unless explicitly authorized in writing by THE AUTHORS.

SUPPORT AND THIRD-PARTY SYSTEMS

THE AUTHORS may, at their discretion, provide user support related to THE SOFTWARE. Any support provided is offered on a best-effort basis only and without any guarantee of response time, resolution time, availability, or successful outcome.

Support availability, response scope, and response times may vary depending on workload, technical complexity, availability, and other circumstances.

Support is limited to issues directly related to the operation of THE SOFTWARE itself. THE AUTHORS are not responsible for, and do not guarantee resolution of, issues caused by or related to third-party systems, services, or configurations, including but not limited to email servers, network providers, firewalls, antivirus software, VPNs, operating system or hardware restrictions, incorrect user configuration, invalid credentials, misspelled addresses, or server-side errors.

Any information, guidance, or suggestions provided by THE AUTHORS regarding third-party systems or environments are offered solely as general informational assistance and do not constitute a guarantee, warranty, or assumption of responsibility for the behavior, availability, security, legality, or correctness of such systems.

TERMINATION

This license will terminate automatically and immediately if you fail to comply with any of the limitations described above. On termination you must cease all use and destroy all copies of THE SOFTWARE and its documentation.

THE AUTHORS reserve the right to terminate your license for material breach or misuse if they conclude that you are not fulfilling your obligations or abuse any part of this license agreement.

THE AUTHORS reserve the right to revise this license agreement at any time. Continued use of THE SOFTWARE after such revision constitutes acceptance of the revised terms. The revised license supersedes all prior versions.

DISCLAIMER OF WARRANTY

THE SOFTWARE is provided on 'AS-IS' basis, without warranty of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk of usage of THE SOFTWARE is on you.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, GOODWILL, COMPUTER FAILURE, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL CUMULATIVE LIABILITY OF THE AUTHORS SHALL NOT EXCEED THE AMOUNT PAID FOR THE LICENSE OR ZERO (0) IF NO FEE WAS PAID.

NO INDEMNIFICATION BY AUTHORS

THE AUTHORS SHALL HAVE NO OBLIGATION TO DEFEND, INDEMNIFY, OR HOLD YOU HARMLESS AGAINST ANY CLAIMS ARISING FROM YOUR USE OR MISUSE OF THE SOFTWARE.

USER INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE AUTHORS FROM AND AGAINST ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING LEGAL FEES) ARISING FROM YOUR USE OF THE SOFTWARE, VIOLATION OF THIS LICENSE, OR VIOLATION OF ANY APPLICABLE LAW OR THIRD-PARTY RIGHTS.

OWNERSHIP

Title, ownership rights, intellectual property rights and author rights of THE SOFTWARE shall remain with THE AUTHORS. International copyright treaties protect THE SOFTWARE.

NO GUARANTEE OF LEGAL COMPLIANCE

THE AUTHORS DO NOT WARRANT THAT THE SOFTWARE COMPLIES WITH ANY LAW, REGULATION, OR REQUIREMENT IN ANY JURISDICTION. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING SUITABILITY AND LEGAL COMPLIANCE.

SEVERABILITY

If any provision of this License is held unenforceable, the remaining provisions shall remain in full force and effect.

NO WAIVER

Failure by THE AUTHORS to enforce any right or provision shall not constitute a waiver of such right or provision.

GOVERNING LAW AND JURISDICTION

This License shall be governed by and construed under the laws of the jurisdiction in which THE AUTHORS reside, excluding conflict of law rules. Any legal action shall be brought exclusively in the courts of that jurisdiction.

ACCEPTANCE

By continuing installation and usage of THE SOFTWARE you automatically accept this license agreement terms and conditions. If you don't accept any of these terms you must quit installation and destroy all copies of THE SOFTWARE.

THIRD PARTY LICENSE ACKNOWLEDGEMENTS AND COPYRIGHT NOTICES

THE SOFTWARE uses third party components which are distributed under separate licences.
